1. Who we are
SailorSkills Pro (“SailorSkills,” “we,” “us”) is operated by Brian Cline, doing business as SailorSkills, based in California. SailorSkills Pro is a subscription software service for marine service providers (hull cleaning operators and similar mobile marine service businesses) to manage scheduling, service logging, customer billing, and related operations. These Terms govern your use of SailorSkills Pro at sailorskills.com and pro.sailorskills.com.
2. Your account and workspace
When you sign up, we create a workspace for your business. You may invite team members (e.g. divers, office staff) to that workspace; the workspace owner is responsible for the conduct of everyone they invite and for keeping login credentials (including any shared tablet PIN) secure. You must provide accurate information when creating your account and keep it up to date.
3. Subscription and billing
SailorSkills Pro is offered on paid subscription tiers (currently Solo and Team), billed monthly or annually, in advance, through our payment processor Stripe. By subscribing you authorize us to charge your payment method on file for each billing period until you cancel.
- You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period unless stated otherwise.
- Fees are non-refundable except where required by law or where we agree otherwise in writing.
- We may change subscription pricing prospectively, with advance notice, for future billing periods.
- Failed or declined payments may result in restricted access until resolved.
4. Your content and your customers’ data
You (and your workspace members) will enter data about your own customers into SailorSkills Pro — boat and contact information, service history, and photos or videos captured during service visits (“Your Content”). As between you and us, you own Your Content. You grant us a limited license to host, store, process, and display Your Content solely to provide the service to you (and, where you configure it, to your customers through the boat-owner portal).
You are responsible for having the rights and consents needed to collect and store your customers’ information and media in SailorSkills Pro, including any consents your customers require under applicable law.
5. Acceptable use
You agree not to:
- Use SailorSkills Pro for any unlawful purpose or in violation of these Terms;
- Attempt to access another provider’s workspace, data, or accounts without authorization;
- Reverse engineer, scrape, or resell access to the service without our written permission;
- Upload content that infringes someone else’s rights or violates applicable law;
- Interfere with or disrupt the integrity or performance of the service.
6. Service availability
SailorSkills Pro is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, and we may modify, add, or remove features, or perform maintenance, at any time. We are not liable for delays or failures caused by our third-party infrastructure or payment providers.
7. Limitation of liability
To the fullest extent permitted by law, SailorSkills and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising out of or related to your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve (12) months before the claim arose.
8. Termination
You may stop using SailorSkills Pro and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, if your subscription payment fails and isn’t resolved, or if we discontinue the service, with reasonable notice where practical. On termination, we will make reasonable efforts to let you export Your Content for a limited period before deletion.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, and any dispute arising from these Terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in California.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or an in-app notice) before the changes take effect. Continued use of SailorSkills Pro after changes take effect constitutes acceptance of the updated Terms.
